JON CARDIN INTERVIEW PART 2: Attorney General Candidate Talks About Marijuana Legalization & Agricultural Pollution

This is part 2 of 3 of Maryland Juice writer Dan Furmansky's exclusive interview with Delegate Jon Cardin (a candidate for Attorney General).

ARTICLE 2 OF 3: JON CARDIN ON REDUCING RECIVDIVISM, MARIJUANA REFORM, & AGRICULTURAL POLLUTION


SECTION 1: JON CARDIN ON THE WAR ON DRUGS, RECIDIVISM & MARIJUANA REFORM

DAN FURMANSKY: There has been a great deal of discussion lately about mass incarceration, especially as it relates to the War on Drugs. The ACLU report you no doubt saw has pointed out the massive disparities in marijuana-related arrests among blacks and whites in Maryland, despite the fact that usage rates among the two communities are completely comparable…

JON CARDIN: The report just said not quite, I think 2.9 or 3 percent…no, 3 times more likely if you’re black to be arrested and incarcerated for marijuana use than if you’re white. I mean, that’s outrageous when usage is essentially equal.

DAN FURMANSKY: So let me ask you this: Some support a bill by your colleague from District 11 [Sen. Bobby Zirkin] to make possession of very small amounts of marijuana a civil, rather than a criminal, offense. But this is considered by many to be merely a band-aid, unfortunately, because law enforcement will still use alleged marijuana possession to target people based on race and it doesn’t do anything to drive away the underground market and regulate who is growing and who is selling marijuana, and to whom, in our state. With Colorado and Washington replacing marijuana prohibition with taxation and regulation of marijuana, do you feel Maryland is ready to make a similar move?

JON CARDIN: I support Senator Zirkin’s bill, number one. Number two, I have supported the movement towards not just decriminalization, but to…the ability to tax and regulate—legalize, tax and regulate—the use of marijuana. I think that not only is this an opportunity for revenue, it’s an opportunity to reduce or get rid of the black market and it allows us to kind of handle firsthand, the inappropriate use in a way that can be dealt with cheaper than incarceration and through the legal process, but rather through an intervention process.

I think that recreational use is…could…will…let’s be transparent here…create other issues, and possibly, other legal ramifications, and cultural, and community ramifications that need to be considered. But I am certainly open to the conversation about doing it, because we need to look at new, next-generation ways of controlling the problem side and to providing a community that actually works well together.

DAN FURMANSKY: As the top law enforcement official, how would you advocate for reforms that would reduce crime and recidivism in the state of Maryland?

JON CARDIN: Um…I would contend that you, you said the top law enforcement official?

DAN FURMANSKY: Yeah. Is that a fair assessment of the role of Attorney General?

JON CARDIN: Yeah, the Attorney General does have a capacity to deal with law enforcement. In the criminal system, obviously it focuses on the appeals process. The first thing I would do is, number one, if the state's attorney sent me a case that was in any way polluted with racial profiling, I would refuse to take and handle that appeal. Period. And what that says is that…the state's attorney needs to be very, very…focused on doing the right thing and making sure that all their i’s are dotted and t’s are crossed.

In terms of recidivism, we have tremendous opportunities and we have a terrible record of, you know, 80% recidivism in certain arenas. But we know the answer. There are programs that have shown dramatic decrease in recidivism like the Maryland Cares—I’m going to get the name wrong, but I have to jog my memory for it—which is a program for re-entry of violent crime individuals where you have a person go in and work with an individual, an inmate before they are released, in advance, close to when they are going to be released, and work with the family to set them up and prepare them for re-entry. [The Maryland Correctional Enterprises CARES program]. And it has shown a more than 40% drop in recidivism.

The problem is funding, and the issue that we have is how can the Attorney General help advise the Administration and Department of Corrections and the Governor's Office on crime prevention or making sure that those programs are funded because when we’re paying up to $50,000 a year for an inmate versus a couple thousand dollars a year to have these re-entry programs done, it’s a no brainer to make sure that happens.


SECTION 2: JON CARDIN ON THE AGRICULTURAL POLLUTION & THE ENVIRONMENT

DAN FURMANSKY: Quick question on ag [agricultural] pollution.

JON CARDIN: 1029? Senate Bill 1029?

DAN FURMANSKY: Was that the Ag Certainty bill? Yes, I wanted to positively call out your vote…on the so-called Ag-Certainty bill. [Editor's Note: Del. Cardin was one of 27 legislators to vote against the “Maryland Agricultural Certainty Program” legislation which would grant certain agricultural operations a whopping 10-year exemption from new rules to protect water quality. The bill passed and was signed into law by Gov. O’Malley. Del. Braveboy supported the legislation, while Del. Frick and Sen. Frosh also voted against it.]

Farming in Maryland remains the largest source of pollution to the Chesapeake Bay, and within agriculture, it is manure application to fields that takes the pollution prize. A 2010 study estimated that farms on Maryland’s Eastern Shore produce 300,000+ tons of excess poultry litter beyond the capacity of local cropland to assimilate nutrients. And of course the vast majority of farms on the Eastern Shore are part of the factory farming system, where they are contracted to either grow chickens as food crops or provide soy or grains as feed to one of the so-called multi-billion dollar integrators who produce poultry, such as Tyson, Perdue, and Mountainaire.

It’s clear that if we in Maryland don’t successfully address the issue of poultry manure that comes from this factory system, we won’t get clean water. Given this, how will you prioritize enforcing the Clean Water Act against the poultry industry, including these big poultry integrators who operate their grower facilities?

JON CARDIN: Number one, I mean obviously, you have to look at each case as it comes and determine whether there is a legitimate case and a legitimate issue and then devote the resources appropriate to the issue. My goal, my vision and my philosophy has been always been ends-tested programs. What is it that we’re trying to accomplish? We’re tying to accomplish a cleaner Chesapeake Bay. If we are, what’s the way to get there? The way to get there is to mediate the use of these environmental hazards in a way that’s more expeditious, less expensive than litigation and actually accomplishes our goal faster and in more friendly environment and I will do that. And if it means I have to go after the bad actors to demonstrate that those of you guys who are on the verge better clean up your act, then we’ll do that as well. I don’t believe that the status quo will work because our Bay depends on us on figuring out how to clean it up. But I also believe that we have to also look at other ways than simply just litigating our way out of it. I just think that that’s going be too slow, laborious, and expensive.

DAN FURMANSKY: Have they done much litigation? I mean Attorney General Gansler hasn’t done any ag litigation in Maryland….

JON CARDIN: Hudson Farms. [Editor's Note: The case at hand involved litigation against Perdue and its chicken-raising contractor on the Lower Eastern Shore, the Hudson Farm, for allegedly violating the Clean Water Act and polluting the Pocomoke River and Chesapeake Bay. The plaintiffs lost the case when the judge found the point source of the pollution could plausibly have been cattle roaming on the farm, as opposed to chicken litter, and cattle manure in this case was not covered under the Clean Water Act. Notably, the Hudsons did not file a nutrient management plan, as required by law, for five years, and also acknowledged that they failed to conduct a soil test on the farm, despite being required to do so every three years. Nevertheless, following the resolution of the case, the House of Delegates authorized $300,000 in taxpayer money for the legal fees of Alan Hudson, the farmer.]

DAN FURMANSKY: I mean, that wasn’t the state’s involvement. That was the University of Maryland Environmental Law Clinic.

JON CARDIN: The Attorney General’s Office gave…he didn’t have his hands on it, but the Attorney General’s Office was certainly involved in making sure that was proceeding. It had to. They’re the ones who are given the authority to do that kind of thing…

DAN FURMANSKY: My understanding of it was that it was litigated by the Waterkeeper Alliance with the assistance of the University of Maryland Environmental Law Clinic. From conversations that I’ve had, with some of the attorneys who had been involved in the case, I don’t think they felt that the Attorney Gansler was aggressive with Maryland-based ag polluters.

JON CARDIN: Obviously he has not been the lead on anything, I don’t think they were directly involved, but they were certainly aware of what was going on and they were…they did not stop the litigation even at the point they realized that was going to fail.

DAN FURMANSKY: So let me ask you a specific legislative question: there was an amendment to the budget reconciliation bill that gave the Board of Public Works the authority to grant funding to recoup the legal expenses of the Hudson farm. Did you vote for that?

JON CARDIN: I don’t remember what I did, but I probably would have. I mean, let’s be honest, the state lost the case. [Editor’s Note: this was not a case litigated by the state, but by the Waterkeeper Alliance].

DAN FURMANSKY: Would we reimburse any other industry? I mean the Hudsons, they are businesspeople. They run a business in Maryland. Shouldn’t this be a part of the cost of doing business in Maryland?

JON CARDIN: Uh, so, attorneys fees is a whole separate question. The question is…do we allow attorneys fee for any business…and I am open… I believe that if you do allow attorneys fees, you give incentives for people to really figure out which issues are the ones that are the most important to litigate, or which ones are the strongest to litigate. Because we as a society cannot afford…I just don’t think we can afford to make litigation our only way of improving the environment. It’s got to be an open, transparent conversation, I just philosophically believe that.

DAN FURMANSKY: Some people say that the case shone the spotlight on the fact that in Maryland, these nutrient management plans are secret. They are shrouded in secrecy. Somebody from the general public…

JON CARDIN: That’s a 1029 issue also.

DAN FURMANSKY: Do you support making nutrient management plans open and available for the public to see?

JON CARDIN: I have no problem with transparency. I know that there are trade secret issues that are out there and I think there are ways to create transparency, or at least to provide information, even if it’s through confidential communication, in order to make sure that, you know, we can actually use our finite resources to go after folks that are actually the real bad actors.

DAN FURMANSKY: Traditional point sources of pollution under the Clean Water Act (such as power plants and wastewater treatment plants) view water pollution trading as a way to avoid meeting current Clean Water Act permit requirements. Another words, instead of upgrading plants to meet permit limits, they purchase the right to pollute. How will you enforce permits where point source facilities can purchase their way out of compliance?

JON CARDIN: Again, looking at the office of Attorney General, the question is: what are we allowed to do? And how can we enforce that if it’s legal? But from a public policy standpoint, my goal would be to clean the Bay. And if this is working against that goal, then we need to work both from the perspective of the Attorney Generals’ Association—the National Attorney Generals’ association, NAAG, as well as contacts that we have in Washington, D.C. to make sure that—I’m assuming this is federal by nature—and certainly I have plenty of contacts from my old life in D.C. and from my family and other folks to be able to work with them to make sure that the end goal is what’s accomplished and not a way of getting around it through the mechanisms that are aimed to…to try to improve, but in a much more, I guess, slower or inefficient way.

POLL: Maryland Democrats & Republicans Divided on Pot Legalization, Gun Control, Immigration & Marriage Equality

Goucher College released a new poll last week highlighting Marylanders' opinions on a range of issues including marijuana, marriage equality, gun control and immigration reform. Below you can see the results of the poll, including breakdowns by political party affiliation and race. I've flagged a few of the more interesting results below.

STATEWIDE SUMMARY: The major items in Goucher's statewide poll reveal that:
  • 72% of Marylanders think marriage equality either changed things for the better or had no effect, while only 23% think it changed things for the worse. 
  • On gun control, 54.5% of voters think the new gun regulations were about right or not strict enough, while only 26.6% think they were too strict. 
  • On immigration, 53.4% of Marylanders support allowing undocumented immigrants to keep their jobs and apply for citizenship, while only 25.9% think we should kick undocumented immigrants out of their jobs and the country. 
  • On the War on Drugs, 50.9% of Marylanders support or strongly support marijuana legalization, whereas 40.3% of residents oppose or strongly oppose legalization. 
  • But on the issue of whether jail time is an appropriate penalty for marijuana possession, only 5.8% of Marylanders support criminalizing marijuana. In contrast, 82.6% of residents support changing the penalty for possession to a ticket or rehab.

DEMOCRATS & REPUBLICANS DIVIDED ON MARIJUANA LEGALIZATION, GUN CONTROL, IMMIGRATION AND MARRIAGE EQUALITY - When you consider that Maryland is effectively a one-party state (where most high-profile races are won in the Democratic Primary), it becomes useful to take the statewide polling numbers above with a grain of salt. Indeed, when you restrict the survey results to only Democrats or Republicans, the results shift quite a bit and reveal partisan divides on these hot-button issues.

A strong majority of Democrats, Independents and third party residents support marijuana legalization, whereas Republicans were the only group where respondents were more likely to oppose than to support legalization. But even still, nearly 2 in 5 Republicans support legalization (aka almost half). On immigration, a super-majority of Democrats support allowing undocumented immigrants to stay and seek citizenship, but Republicans were divided with 39% seeking to kick them out, and 31% allowing them to stay and seek citizenship. RESULTS BY RACE FOR MARIJUANA AND IMMIGRATION - There are a few more interesting items in Goucher's polling crosstabs (which you can read below), but I would note a couple tidbits. A strong majority of black Marylanders support marijuana legalization, though a majority of white Marylanders also support legalization. The non-white/non-black category is the only race group where more respondents opposed than supported legalization, albeit by a slim margin of 3%. Black Marylanders were also the strongest supporters of immigrant rights, with 62% of black respondents supporting allowing undocumented immigrants to stay in their jobs and seek citizenship. VIDEO: Candidates for Attorney General Support Marijuana Decriminalization // PLUS: Majority for Legalizing in Gallup Poll

ALL FOUR DEMOCRATIC CANDIDATES FOR ATTORNEY GENERAL SUPPORT MARIJUANA DECRIMINALIZATION - Last night Maryland Juice attended a packed Democratic candidates forum for the state's heated Attorney General race. Though Sen. Brian Frosh could not make the event, Delegates Aisha Braveboy, Jon Cardin & Bill Frick showed up at the Wheaton Library to talk about law enforcement, consumer, civil rights and environmental issues.

Given that efforts to remove jail penalties for non-violent marijuana possession have stalled in the State House, I decided to ask the Democratic candidates whether they supported Sen. Bobby Zirkin's legislation to remove jail-time as a penalty for pot possession. As luck would have it, it appears that every single Democratic candidate for Maryland's top law enforcement office supports marijuana decriminalization (see the video below):



Though Sen. Brian Frosh was not available to answer this question at last night's forum, it is worth noting that he already voted in favor of Sen. Bobby Zirkin's bill to remove jail-time as a penalty for marijuana possession. That means that every single Democrat running for Attorney General supports marijuana decriminalization, and at least one gubernatorial candidate (Heather Mizeur) has also gone on record supporting this common-sense reform.


NEW GALLUP POLL SHOWS SUPER-MAJORITY OF DEMOCRATS SUPPORT POT LEGALIZATION  //  MARIJUANA REFORM GOES MAINSTREAM - It is worth noting that the marijuana reform proposal advancing in Maryland is a "decriminalization" bill that would replace jail penalties for possession with civil fines (like a traffic ticket). This is a step below marijuana "legalization" policies (eg: to tax and regulate pot similarly to alcohol) that have been passed in Washington and Colorado. But once again, it appears that the public is more forward-thinking than lawmakers on issues.

A new Gallup poll released yesterday shows that a strong majority of Americans (58%) support full-on marijuana legalization, and the trend line on these numbers is very clear. Additionally, among Democrats support for marijuana legalization is at a whopping super-majority of 65%. Gallup's write-up of the poll results notes that the surge in marijuana support is following the same trajectory we witnessed with marriage equality, and (not surprisingly) most of the opponents are again Republicans (excerpt below):
GALLUP:  For marijuana advocates, the last 12 months have been a period of unprecedented success as Washington and Colorado became the first states to legalize recreational use of marijuana. And now for the first time, a clear majority of Americans (58%) say the drug should be legalized. This is in sharp contrast to the time Gallup first asked the question in 1969, when only 12% favored legalization....

A sizable percentage of Americans (38%) this year admitted to having tried the drug, which may be a contributing factor to greater acceptance....

The movement to legalize marijuana mirrors the relatively recent success of the movement to legalize gay marriage, which voters have also approved now in 14 states. Public support for gay marriage, which Americans also overwhelmingly opposed in the past, has increased dramatically, reaching majority support in the last two years....

Independents' growing support for legalization has mostly driven the jump in Americans' overall support.... Yet there is a marked divide between Republicans, who still oppose legalizing marijuana, and Democrats and independents.



So what's the hold-up, folks? Will Maryland drag its feet on this social justice issue and wait for other states to lead (again)?

POLL: Majority of Marylanders Support Marijuana Legalization // PLUS: Montgomery Democrats Rally for Minimum Wage Hike

Ahead of the 2014 legislative session, Maryland Juice has been tracking the activities of advocacy groups and activists in the state. It seems clear that there is a lot of organizing happening behind two policy areas: ending the War on Drugs and increasing the minimum wage. Below we provide updates on both issues, including a new poll on marijuana reform and coverage of a press conference yesterday on raising the state's minimum wage.

JUICE #1: STRONG MAJORITY OF MARYLAND VOTERS SUPPORT MARIJUANA LEGALIZATION - This morning, Maryland Juice received the following press release from the ACLU and the Marijuana Policy Project announcing new poll results showing a majority of Maryland voters support taxing and regulating marijuana in the same manner we treat alcohol sales. Poll: Majority of Maryland Voters Support Regulating and Taxing Marijuana; Only 38% Opposed

More than two-thirds support removing criminal penalties for marijuana possession and replacing them with a civil fine similar to a parking ticket

BALTIMORE — A majority of Maryland voters (53%) support making marijuana legal for adults and regulating it like alcohol, according to a survey conducted last weekend by Public Policy Polling. Only 38% said they were opposed.

The poll also found that more than two-thirds (68%) support removing criminal penalties for possession of up to one ounce of marijuana and replacing them with a civil offense punishable by a fine of up to $100 with no possibility of jail time. Only 26% said they were opposed. Under current Maryland law, it is a criminal offense for a person to possess a small amount of marijuana, and he or she can be sentenced to up to 90 days in jail and fined up to $500.

The survey of 678 randomly selected Maryland voters was conducted September 27-29 and has a margin of error of plus or minus 3.8%. The full results are available at http://www.aclu-md.org/press_room/147.

Statement from Rachelle Yeung, legislative analyst for the Marijuana Policy Project:

"Most Maryland voters recognize that marijuana prohibition has failed and believe it is time to adopt a more sensible approach. By regulating marijuana like alcohol we can take marijuana sales out of the underground market and put them behind the counters of legitimate, tax-paying businesses. Marijuana is objectively less harmful than alcohol, and it is time to treat it that way."

Statement from Sara Love, public policy director for the American Civil Liberties Union (ACLU) of Maryland:

"Our current marijuana prohibition policies are grossly ineffective. It's time to take a commonsense approach to public safety and criminal justice. We should not be wasting resources arresting people simply for possessing marijuana. Enforcement of these misguided marijuana laws is having a disproportionate and detrimental impact on communities of color. A majority of voters agree it is time for a change."

Speakers at the Raise Maryland event included County Executive Ike Leggett, Sen. Jamie Raskin, Del. Anne Kaiser, and County Councilmembers Marc Elrich and Valerie Ervin. Other attendees included Del. Montgomery County elected officials pledge to raise Maryland’s minimum wage

Momentum is building for an increase to $10.10 per hour by 2016 for state’s lowest paid workers

Takoma Park, MD – Montgomery County legislators are pledging to pass a bill raising the state’s minimum wage from $7.25 to $10.10 per hour during the 2014 Maryland General Assembly. On October 1, the Montgomery County Council unanimously passed a resolution supporting raising the rate for the state’s lowest wage workers.

At a press conference in Takoma Park, Del. Anne Kaiser and Sen. Jamie Raskin, co-chairs of the Montgomery County legislative delegation detailed why they believe that it is the right time to increase the minimum wage in Maryland.  Montgomery County Executive Ike Leggett and Montgomery County Council members Valerie Ervin and Marc Elrich also spoke at the event.

“Raising the minimum wage is a top priority for the upcoming legislative session. And it’s not enough to just pass any minimum wage increase,” said Sen. Raskin. “We will be advocating for a strong bill that raises the rate to $10.10, indexes the minimum wage to inflation and includes a raise for tipped workers.”

The proposed legislation would raise Maryland’s minimum wage in three steps to $10.10 per hour by 2016 and index it to the cost of living thereafter so that it doesn’t lose value over time. The legislation also incorporates an increase for tipped workers (from 50 percent to 70 percent of the prevailing minimum wage).

“It is time for the General Assembly to act on wages, to raise the standard for all workers,” said Del. Kaiser. “That includes tipped workers – restaurant workers, barbers, nail technicians, car wash employees – everyone who depends on tips as part of their income.”

Momentum is building for Maryland to increase the state’s minimum wage during the upcoming 2014 session of the Maryland General Assembly.  The Baltimore City Council also recently passed a unanimous resolution calling for an increase and each of the Democratic 2014 gubernatorial candidates have announced their support for a raise.

“With passage of this resolution, Montgomery County stands united in support of higher pay for our workers and building our county and state economy,” said County Executive Leggett. “An increase will also stimulate business and spending and we always welcome more business here in Montgomery County.”

The press conference was held at Capital City Cheesecake, a café and bakery in Takoma Park.  Meaghan Murphy, who owns the business with her sister, spoke in support of a wage increase. “Even though it’s a challenge to meet this higher wage, at the end of the day we’re not in business for solely our own benefit,” said Murphy. “We shouldn’t be in business if we can’t provide another dollar or more per hour to our workers.”

Councilman member Elrich, who introduced the measure, also addressed concerns about small business, saying, “We hear from the business lobby that a raise in the minimum wage will hurt business. They say that it’s a job killer and small businesses will be most affected. In fact, across Maryland, 71 percent of all low-wage workers are employed by businesses with more than 50 employees, like big box retailers and fast food restaurants.”

“We talk about understanding the face of poverty, but it faces we see every day in Montgomery County – working families trying to put food on the table, ensure a quality education for their kids and keep up with bill payments,” said Ervin. “With one of the highest standards of living in the state, we are leaving our low wage workers behind.”

A low-wage worker, Wilfred Mokoko, also spoke at the event, detailing the struggles he faces living on the minimum wage.  “At the start, the wages were fair, but as the cost of living has increased, I saw my wages were too low. The Ride On bus fare has increased from $1.20 to $1.80.  To many people these changes do not make a difference, but they matter to me. Some weeks, I spend more than $20 on bus transportation. When you make $7.25 an hour, this really hurts.”

Research has found that approximately 472,000 Marylanders would benefit from the increase, putting $466 million more in their pockets in the next two years. VIDEO: Maryland Juice Blogger David Moon Asks Doug Gansler About Drug War // PLUS: Obama Changes Tune on Marijuana

UPDATE: Maryland Juice must have a good read on where progressive policy is headed, because The Washington Post reported today that the Obama administration will not fight states that have legalized marijuana distribution (excerpt below):
WASHINGTON POST: The Obama administration on Thursday said it will not stand in the way of Colorado, Washington and other states where voters have supported legalizing marijuana either for medical or recreational use, as long as those states maintain strict rules involving distribution of the drug.

In a memo sent Thursday to U.S. attorneys in all 50 states, Deputy Attorney General James M. Cole detailed the administration’s new stance.... The memo directs federal prosecutors to focus their resources on eight specific areas of enforcement, rather than targeting individual marijuana users, which even President Obama has acknowledged is not the best use of federal manpower. Those areas include preventing distribution of marijuana to minors, preventing the sale of pot to cartels and gangs, preventing sales to other states where the drug remains illegal under state law, and stopping the growing of marijuana on public lands....
BACKGROUND: About two weeks ago, Maryland Juice attended a Montgomery County forum with Attorney General Doug Gansler on transportation issues. This was only one day after Gansler had been roundly criticized in the media for implying that Lt. Governor Anthony Brown's campaign was focused on the color of the candidate's skin. But rather than pile-on the follow-up coverage of the remarks, I decided to pursue a more substantive line of questioning for Doug Gansler on race issues in Maryland.

At the August 13th forum with Gansler, I had the perfect opportunity to jump into the conversation, when an audience member started asking Gansler about U.S. DOJ Chief Eric Holder's recent decision to focus on addressing the issue of mass incarceration. Indeed, Holder recently announced a new effort to reform mandatory minimum sentencing rules and use of prosecutorial discretion. Gansler's response to the audience member focused on his newly announced effort to facilitate the re-entry of prisoners into the civilian population, so I decided to ask a follow-up question.

THE PERILS OF SMOKING WHILE BLACK IN MARYLAND - It seemed to me that Gansler's focus on re-entry issues was only 1/4 of a response to the problem of mass incarceration, as re-entry deals with people leaving prison, without addressing whether these non-violent offenders should be incarcerated in the first place.  I've been noting for months that it is impossible to tackle America's lust for imprisoning the poor and people of color without addressing our decades-long failed "War on Drugs" policy advanced through Presidents ranging from Nixon, Reagan, Bush, Clinton and now Obama. Though Democratic policymakers around the nation have begun aggressively attacking this problem at its roots, Maryland Democrats have ordinarily dragged their feet on such issues.  The result is a cost of nearly $200 million a year to prosecute marijuana crimes in Maryland, and the U.S. now has the world's largest prison population -- despite having a much smaller population than say, China. Even worse, the ACLU recently reported that black residents of Maryland are over 3 times more likely than white residents to be busted for pot crimes -- despite equal rates of use between the races.

Below you can watch an exclusive video of Doug Gansler's response to a problem that the ACLU has dubbed "Smoking While Black." In the comments below, Gansler states: "It's a real issue and the whole marijuana issue has been dealt with I think appropriately, differently in many states. Where we go with that here, I think we're actually taking a very good approach to it in my own personal view. But the racial component is something that should always be of concern... We have to have a full understanding that it's disproportionately affecting minority communities."



Let's see if Attorney General Doug Gansler (and other gubernatorial candidates) will walk the talk when the issue emerges again in the next legislative session.

Maryland Senate Votes to Decriminalize Pot Possession While House Approves Medical Marijuana // ROLL CALL ANALYSIS

READER: Students for Sensible Drug Policy sent out an email blast calling on its MD members to "Urge Chairman Vallario to pass marijuana decriminalization in Maryland" etc. with some indication that he as the committee chairman "has been the main obstacle to passing positive marijuana legislation in Maryland." Let's hope this common sense reform makes it through!

Reforms to Maryland's draconian laws regarding marijuana are finally advancing in the State Senate and House of Delegates. After years of severe lag-time, Maryland Democrats have finally caught on that the world is moving on after blindly experimenting with the last generation's failed "War on Drugs."

Maryland currently spends roughly $226 million a year on marijuana enforcement -- with little meaningful impact on the public's use of recreational drugs.  Meanwhile, young Marylanders and people of color are arbitrarily and disproportionately welcomed into the criminal justice system, subjecting them to potential ineligibility for student loans and persistent problems finding employment.

MARYLAND SENATE APPROVES MARIJUANA DECRIMINALIZATION - Last week the Maryland Senate approved a bill to eliminate the possibility of jail terms for "de minimis" marijuana possession (aka a few joints or less). A bill sponsored by Senator Bobby Zirkin proposes to reduce the penalty for minor pot possession to no more than a $100 fine with no jail time at all. The bill was approved by a vote of 30-16 in a surprisingly smooth vote, and The Washington Post editorial board recently encouraged the House of Delegates to join the Senate in decriminalizing pot (excerpt below):
WASHINGTON POST: The Maryland Senate’s vote to decriminalize possession of small amounts of marijuana would not, as some critics warn, make it okay to use the drug. Such use would still be illegal, but it would be a civil offense, punishable by fines rather than imprisonment. Not only would this save law enforcement valuable resources but also prevent the lives of many young people from being ruined. We hope the House of Delegates follows the Senate’s lead and that Gov. Martin O’Malley (D) signs this sensible measure into law....
Currently Maryland law allows for up to a shocking 90 days in prison and a $500 fine for possession of minor amounts of pot. But despite the common-sense nature of this "decriminalization" law, the vote to start ending the War on Drugs in Maryland revealed interesting divisions between lawmakers. You can see the full roll call online, but below Maryland Juice highlights a few notable tidbits.

NINE SENATE DEMOCRATS VOTED TO MAINTAIN 90 DAY JAIL TERMS FOR MARIJUANA - The vast majority of Senate Democrats voted to eliminate the possibility of 90 day jail terms for residents caught with small amounts of marijuana.  Democratic leaders --  including Senate President Mike Miller -- voted for marijuana decriminalization, and only nine of Maryland's thirty-five Democratic Senators voted to support continued incarceration of people caught with pot. But surprisingly, two of the "no" votes came from Senators Nancy King and Roger Manno, who represent liberal Montgomery County. Below you can see the nine Democratic Senators who voted against peeling back the War on Drugs in Maryland:

SENATOR ROGER MANNO EXPLAINS VOTE TO MAINTAIN POSSIBILITY OF JAIL FOR POT POSSESSION - Interestingly, shortly after the historic marijuana reform vote, Senator Roger Manno explained to Maryland Juice why he voted to maintain possible 90 day jail terms for minor pot possession. Manno stated that he thought the War on Drugs was a failure but that it was arbitrary to only roll back penalties on marijuana. I'm still a little confused by this argument, but if drug reform advocates take Senator Manno at his word, that means he should be approached to sponsor an even larger unraveling of the War on Drugs in Maryland  -- perhaps a bill that comprehensively audits and revisits jail terms assigned to all cases of simple possession?


NEARLY 50% OF REPUBLICAN SENATORS VOTED AGAINST 90 DAY JAIL TERMS FOR POT - While some Democrats struggled to stay on top of shifting public sentiment on marijuana, the Republicans are beginning to catch on. Notably, five out of twelve Republican Senators (or nearly 50%) voted to eliminate the threat of 90 day jail terms for minor pot possession:

  3. Nancy Jacobs (Cecil & Harford Counties)

MEANWHILE, MD SENATE VOTES TO MAKE POSSESSION OF SYNTHETIC MARIJUANA PUNISHABLE BY FOUR YEARS IN JAIL - In one of the signs of how dysfunctional and irrational drug policy is in America, only days after the Maryland Senate voted overwhelmingly to decriminalize pot possession -- Senators also voted unanimously to make possession of synthetic marijuana punishable by up to four years in prison. Last week, Maryland Senators voted to add synthetic marijuana to the state's list of "Schedule I" substances -- making simple possession a crime that could land you in jail for years. This may have been a pro-forma step to conform Maryland's criminal code with the Federal Schedule I, but we are already beginning to move away from compliance with Barack Obama's broken campaign promises on drug reform. One step forward, two steps back on ending the failed War on Drugs in Maryland? Oy!


MARYLAND HOUSE FINALLY APPROVES MODEST MEDICAL MARIJUANA LAW - While the Maryland Senate was busy decriminalizing possession of minor amounts of pot, the House of Delegates was debating whether to allow medical marijuana in Maryland. But today they finally voted to approve a modest program to allow distribution of marijuana for medical purposes. The medical marijuana bill passed by a whopping margin in a 108 to 28 vote. The Capital Gazette reported on the break in the logjam (excerpt below):
CAPITAL GAZETTE: The House of Delegates passed a bill Monday to allow a small number of academic medical centers to distribute marijuana to patients beginning in 2016. Delegates voted 108-28 to pass House Bill 1101, introduced by Del. Dan K. Morhaim, D-Baltimore County. The bill would create a commission through which academic medical research centers could apply to operate medical marijuana programs. The bill now heads to the Senate, where it could get a hearing as soon as this week....

With just 15 days left in the General Assembly's 90-day session, marijuana will be an important issue in both chambers. On Thursday, the House Judiciary Committee is expected to take up Senate Bill 297, which would decriminalize possession of less than 10 grams of marijuana. The Senate passed that bill on March 19....

THERE'S DEFINITELY SOMETHING IN THE AIR - Most Americans consider the War on Drugs a policy failure, and Maryland Juice has been pointing out for months that a super-majority of Democrats and liberals nationally now support full-on taxation and regulation of pot (even Senate President Mike Miller). Indeed, a 2012 Huffington Post/YouGov opinion survey confirmed the clear shift in attitudes:
HUFFINGTON POST: A solid majority of Americans support legalizing marijuana, either with or without taxes and regulations similar to those imposed on alcoholic beverages, according to a new survey conducted by YouGov for The Huffington Post.

The poll found that 51 percent of adults support legalizing, taxing and regulating marijuana like alcohol.... Only 26 percent of respondents said that marijuana should not be legalized.... Those under age 29 and between ages 45 and 64 were most likely to support legalization pure and simple...
The poll found more variation among people of different political parties. Sixty-four percent of Democrats ...  said they supported legalization with taxes and regulations. Overall, opposition was highest among Republicans, but even so, more Republicans favored one of the two legalization options (47 percent) than opposed legalization entirely (44 percent).

A 2011 Gallup poll also verified new majority support for marijuana reform and noted that a whopping 69% of liberals support the legalization effort. Check out a few summary tables below:
